Terms and conditions

Last updated: 12 October 2026

1. About these terms

1.1 These terms set out the agreement between you, the business taking a website from 99 Websites (“you”, “your”), and us, Alex Bennett, a sole trader trading as Amazing Design Services and 99 Websites, of 50 Harvel Avenue, Rochester, Kent, ME2 3JU, United Kingdom (“we”, “us”, “our”).

1.2 You can contact us at hello@99websites.co.uk or on 07988 998941.

1.3 By signing up, paying for or using the Service, you agree to these terms on behalf of your business. If you are accepting them on behalf of a company or other organisation, you confirm you have authority to do so.

1.4 Business customers only. The Service is for businesses, sole traders and other organisations acting for business purposes. It is not offered to consumers, and by accepting these terms you confirm you are not acting as a consumer.

2. Definitions

In these terms:

  • “Service” means the design and build of your website and its ongoing hosting, security, backups, updates, support and changes, as described in clause 3.
  • “Website” means the website we design and build for you under these terms, including its design, layout and code.
  • “Your Content” means the material you give us for the Website, such as your logo, photos, text, prices and business details.
  • “Domain” means the web address your Website uses (for example yourbusiness.co.uk).
  • “Monthly Fee” means the monthly charge for the Service (currently £99 a month), or any other price agreed with you in writing.
  • “Go-live” means the day your Website is first published on your Domain.

3. The Service

3.1 For the Monthly Fee we will:

  • (a) design and build your Website, with no upfront build fee;
  • (b) host it on our hosting, with an SSL certificate (the padlock in the browser);
  • (c) keep regular backups and monitor it for security problems;
  • (d) keep its software up to date;
  • (e) set up basic search engine optimisation, such as page titles, descriptions and a sitemap;
  • (f) show your latest Google reviews on the Website where you have a Google Business Profile; and
  • (g) make reasonable updates and changes you ask for during your subscription (see clause 6).

3.2 We aim to have your Website live within 10 working days of your discovery call. This depends on you sending us Your Content and feedback promptly, and is a target, not a guarantee.

3.3 Before Go-live we will show you the Website and make reasonable changes so that you are happy with it.

4. Your domain name

4.1 If you already own a Domain, or you would rather buy one yourself, it stays registered to you. You give us the access we need to point it at your Website.

4.2 If you don’t have a Domain, we can buy one for you and pay for its renewals while your subscription continues.

4.3 We will never hold your Domain hostage. Whenever your subscription ends, including if you cancel within the first 12 months, we will transfer a Domain we bought for you into your name or to the provider of your choice at no charge, as soon as reasonably possible after you ask. After the transfer you are responsible for renewing it.

5. Fees and payment

5.1 The Monthly Fee is collected by Direct Debit through our payment provider, GoCardless. There is no upfront build fee, no setup fee and no minimum contract.

5.2 Your first payment is collected on the day you sign up. It is a part-month (pro-rata) amount that covers the rest of that month, worked out as the Monthly Fee divided by the number of days in the month, multiplied by the number of days left in the month (including the day you sign up). For example, signing up on 12 October (20 days left of a 31-day month) means a first payment of £99 ÷ 31 × 20 = £63.87.

5.3 After that, the full Monthly Fee is collected on the last day of each month, and covers the month that follows. So the payment on 31 October covers November.

5.4 All prices are in pounds sterling. We are not VAT registered, so no VAT is charged.

5.5 We may change the Monthly Fee by giving you at least 30 days’ notice by email. The new fee applies from your next payment after the notice period. If you don’t agree, you can cancel before the change takes effect.

5.6 If a payment is more than 7 days late, we may suspend the Website after telling you, until the payment is made.

6. Changes and support

6.1 Small changes are included in the Monthly Fee, such as updating text, prices or opening hours, swapping or adding pictures, and adding or removing team members. Send them by WhatsApp or email and we will usually make them within one working day.

6.2 Larger updates (such as new pages or features, online shops or a redesign) and regular updates (such as frequent blog posts or ongoing content changes) are not included. We will price them and agree the price with you before any work is started.

6.3 Support is available on weekdays by WhatsApp, phone and email. We aim to respond within one working day.

7. Cancellation

7.1 There is no minimum contract. You can cancel at any time by giving us 30 days’ notice by email or WhatsApp. Your subscription ends when the notice period ends. Payments that fall due during the notice period are still payable, and no payments are taken after it ends. Please don’t cancel your Direct Debit until the notice period has ended.

7.2 Payments already made are not refundable, except where these terms or the law say otherwise.

7.3 We may cancel your subscription on at least 30 days’ notice for any reason, and will refund any payment you have made for the period after cancellation.

7.4 We may suspend or end the Service immediately by written notice if you seriously or repeatedly breach these terms and, where the breach can be put right, you don’t put it right within 14 days of our notice.

8. Who owns what

8.1 Your Content is always yours. You keep all rights in your logo, photos, text and other material. You give us permission to use it to build, run and update the Website.

8.2 The Website. Because we pay for the design and build of the Website upfront, the Website (its design, layout and code) belongs to us for the first 12 months of your subscription. During that time we give you the right to use it for your business while your subscription continues.

8.3 After 12 months of payments, the Website is yours to keep. If you cancel after that point, we will give you a copy of the Website’s files and Your Content so you can host it wherever you like, and we will transfer any Domain under clause 4.3.

8.4 If you cancel within the first 12 months, the Website stays with us and we will take it offline when your subscription ends. You can still take your Domain straight away under clause 4.3, and we will return Your Content to you if you ask.

8.5 Some features rely on our own systems and stop when the Service ends, such as the automatic Google review feed, our hosting and our contact form delivery. Third-party products we use (such as fonts, icons or stock photos) remain under their own licences.

8.6 You agree we may show the Website in our portfolio and name you as a client. You can ask us to stop at any time by emailing us.

9. Your responsibilities

9.1 You must:

  • (a) give us accurate information about your business and keep it up to date;
  • (b) only send us Content you have the right to use, and make sure it is lawful, accurate and doesn’t infringe anyone else’s rights;
  • (c) make sure any claims on your Website, such as qualifications, accreditations, insurance or reviews, are true; and
  • (d) tell us promptly if anything on the Website is wrong.

9.2 You are responsible for your business’s compliance with laws that apply to it, such as consumer, advertising and data protection law. We can help with wording, but we don’t give legal advice.

10. Availability

10.1 We aim to keep the Website available at all times but don’t guarantee it will be uninterrupted or error-free. We may need to carry out maintenance, and will try to do this at quiet times.

10.2 We don’t guarantee any particular position on Google or any number of visitors, enquiries or sales.

11. Personal data

11.1 How we handle personal information is explained in our Privacy Policy.

11.2 Where your Website collects personal data from your own customers (for example through a contact form), you are the controller of that data and we process it on your behalf, only to run the Website and deliver it to you. We will keep it secure, only use sub-processors with equivalent protections, and help you respond to requests from individuals where reasonably possible.

12. Liability

12.1 Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.

12.2 Subject to clause 12.1, we are not liable for any:

  • (a) loss of profits, revenue, business, goodwill or anticipated savings;
  • (b) loss or corruption of data, except our obligation to restore from our most recent backup where reasonably possible;
  • (c) actions, decisions or outages of third parties, such as Google, domain registrars or hosting providers; or
  • (d) indirect or consequential loss.

12.3 Subject to clause 12.1, our total liability to you under or in connection with these terms is limited to the total Monthly Fees you paid us in the 12 months before the event giving rise to the claim.

12.4 You are responsible for, and will compensate us for reasonable losses and costs arising from, any claim brought against us by a third party because of Your Content or your breach of clause 9.

13. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, including outages at hosting, domain or payment providers, or internet failures. If such an event prevents us providing the Service for more than 30 days, either of us may cancel and we will refund payments made for the period not provided.

14. Changes to these terms

14.1 We may update these terms from time to time. For changes that materially affect you, we will give you at least 30 days’ notice by email. If you don’t agree, you can cancel before the change takes effect.

14.2 The current version will always be available at www.99websites.co.uk/terms-conditions/.

15. General

15.1 Transfer. We may transfer our rights and obligations under these terms to another business, for example if we incorporate or sell the business, and will tell you if we do. You may not transfer yours without our written consent.

15.2 Entire agreement. These terms (with any written quote or agreement we send you) are the whole agreement between us about the Service. If a written quote says something different, the quote takes priority.

15.3 Third parties. No one other than you and us has any right to enforce these terms.

15.4 Severance. If a court decides any part of these terms is invalid, the rest stays in force.

15.5 No waiver. If we delay enforcing these terms, we can still enforce them later.

15.6 Notices. We will send notices to the email address you give us. You can send notices to hello@99websites.co.uk.

15.7 Governing law. These terms and any dispute or claim arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
